1. Acceptance of Terms

By accessing or using Illumina ("Service"), operated by Illumina Labs ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Illumina is a credit-based SaaS platform that enables AI-powered content generation (images, videos, music) and automated publishing to social media platforms. Access requires account registration and, for premium features, a paid subscription or credit purchase.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

5. Credits and Payments

The Service operates on a credit system. Credits are consumed per generation and are non-transferable. Purchased credits and subscription fees are non-refundable except as required by applicable law. We reserve the right to modify pricing with 30 days' notice.

6. Acceptable Use

You agree not to:

• Generate content that is unlawful, harmful, defamatory, obscene, or infringing
• Attempt to reverse-engineer, scrape, or exploit the Service
• Use the Service to train competing AI models
• Create deepfakes or synthetic media of real persons without their consent
• Violate any third-party platform's terms of service via automated publishing

7. Intellectual Property

You retain ownership of content you upload. For AI-generated content produced through the Service, you are granted a worldwide, royalty-free license to use, reproduce, and publish that content. We retain no ownership over your generated outputs.

The Illumina platform, branding, and underlying technology remain the exclusive property of Illumina Labs.

8. Third-Party Services

The Service integrates with third-party providers (Replicate, Anthropic, social media platforms). Your use of those integrations is also governed by those providers' terms. We are not responsible for third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR SPECIFIC RESULTS FROM GENERATED CONTENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ILLUMINA LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your account for violations of these Terms at any time. Upon termination, your right to use the Service ceases immediately. Credits are non-refundable upon termination for cause.

12. Governing Law

These Terms are governed by the laws of Germany. Disputes shall be resolved in the courts of Germany, unless mandatory consumer protection law in your jurisdiction provides otherwise.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes via email or in-app notification.
